If you make a purchase using your Atlantic Records Account account, it is your responsibility to make full and timely payment. Atlantic Records cannot be held responsible for consequences due to your failure to make payments in full.

You agree that to process your transactions, the information you enter into your Atlantic Records Account account must be disclosed to merchants and other parties involved in your transaction. We may disclose your credit card number to a merchant only if necessary to process a billing dispute. You acknowledge that we have no control over, and no responsibility or liability for, the use by any merchants of such information or any other information they independently acquire from you or about you. Except as described above, we will not give your individual or purchase information to anyone without your permission. Your Atlantic Records Account information is subject to our Privacy Policy).

You will select a User ID and password upon creating your Atlantic Records Account account. You are responsible for maintaining the confidentiality of the User ID and password, and are fully responsible for all activities that occur under your User ID or password. You agree to (a) immediately notify Atlantic Records Account Customer Service at 1-866-296-6776, of any unauthorized use of your User ID or password or any other breach of security, and (b) exit from your Atlantic Records Account account at the end of each session. Atlantic Records cannot and will not be liable for any loss or damage arising from your failure to comply with this Section 5.

Atlantic Records does not control the Content posted at participating Atlantic Records Account merchants, does not guarantee such Content, and Atlantic Records will not be liable in any way for any Content. You agree to not use the Service to:

1. Purchase any product that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;
2. Harm minors in any way;
3. Impersonate any person or entity, including, but not limited to , a Atlantic Records official or falsely state or otherwise misrepresent your affiliation with a person or entity;
4. Purchase, upload post, email or otherwise transmit any material that contains software viruses;
5. Interfere with or disrupt the Service or servers or networks connected to the Service, or disobey any requirements, procedures, policies or regulations of networks connected to the Service;
6. Intentionally or unintentionally violate any applicable local, state, national or international law.

You agree to indemnify and hold Atlantic Records, and its subsidiaries, affiliates, officers, agents, and partners, harmless from any claim or demand, including attorneys' fees, made by any third party arising out of Atlantic Records Account information you submit, post to or transmit through the Service, your use of the Service, your connection to the Service, your violation of the Terms of Use, or your violation of any rights of another.

You acknowledge that Atlantic Records may establish and modify general practices and limits concerning use of the Service, and may remove Atlantic Records Account accounts that are inactive for an extended period of time. Atlantic Records reserves the right at any time and from time to time to modify or discontinue the Service (or any part thereof) with or without notice for any reason or for no reason. Your correspondence or business dealings with, or participation in promotions of, merchants found on or through the Service are solely between you and such merchant. You agree that Atlantic Records shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings.

The Service may provide links to other World Wide Web sites or resources. You acknowledge that Atlantic Records has no control over such sites and resources. You further acknowledge and agree that Atlantic Records shall not be responsible or liable for any loss alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

You acknowledge and agree that the Service contains proprietary and confidential information that is protected by applicable intellectual property and other laws. Atlantic Records Account is the property of Atlantic Records and is protected by copyright and other laws of the United States and other countries. Together with our licensors, we retain all right, title, and interest in the Atlantic Records Account service and all related content, information, web sites, software, and other materials related thereto. You may use Atlantic Records Account only in accordance with these Terms of Use. Atlantic Records grants you a personal, non-transferable and non-exclusive right and license to use Atlantic Records Account to make purchases from participating merchants. You are not to use the service for any other purpose. Atlantic Records may terminate this license if you violate these Terms of Use.

You expressly understand and agree that your use of the service is at your sole risk. The service is provided on an "as is" and "as available" basis. Atlantic Records expressly disclaims all warranties of any kind, whether express or implied, including, but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement.

You expressly understand and agree that Atlantic Records shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses (even if Atlantic Records has been advised of the possibility of such damages), resulting from use or inability to use the service, from statements or conduct of any third party on the service or any other matter relating to the service.
